What Are My Rights After Being Bitten By a Dog?

The Centers for Disease Control and Prevention reports that more than 4.5 million people are victimized by vicious dog attacks every year. Close to 900,000 of those dog bite victims require medical attention due to the severity of their injury. Of those victims, at least 30,000 need to undergo some form of reconstructive surgery to repair physical damage.

A dog bite is a very traumatic and painful experience. In addition to the immediate shock, agony or discomfort you may be going through, dog bites are also capable of causing further medical problems. A single dog bite could cause extensive soft tissue damage, sever a nerve, subject you to rabies or other diseases, or leave you severely disfigured. Should that occur, you may need surgery to repair the damage and/or regain mobility of the injured area. If you or a loved one has been bitten by a dog, we strongly advise you to contact our firm and schedule to meet with a St. Paul injury attorney as soon as possible.

The state of Minnesota has a very clear and concise dog bite law. Whether you are in a public place, or on the private property of another person, providing you are there legally, you are conducting yourself in a peaceful manner and you have done nothing to provoke the dog, the owner of the dog can be held 100% liable for any injuries you sustained as a result of his or her dog attacking you. The law also states that both the owner, and any individual caring for the dog at the time of the attack, can be held liable for your injuries. Even in cases where the dog owner took reasonable precautions to prevent such accidents from taking place, he or she is still considered to be fully responsible for the dog’s actions. The dog’s previous demeanor plays no part in determining liability in these cases.
